Several people have contacted me recently asking if Casual Elegance Photography is a chain/franchise. They said that for photographs of such an intimate nature (glamour, boudoir or art nudes) they wanted the personal attention that only a small business can offer. I didn’t understand why they would ask, since Casual Elegance Photography has only one location – Roswell, Georgia.
After doing a Google search I found out why. There are others who are using the name Casual Elegance Photography. Each appear to have started their website well after the establishment of Casualelegancephotography.com so I am fairly sure that they realized that Casual Elegance Photography already existed since the URL casualelegancephotography.com was not available and they had to choose something similar for their URL.
We have a Trademark pending on the name and have already established a brand equity in that name. We have been in business since 2000 and have owned the name since then. Our original URL on the internet was M-L-Anderson.com where we hosted Casual Elegance Photography. Since 2002 we have also owned the casualelegancephotography.com URL which was used to redirect to Casual Elegance Photography on M-L-Anderson.com. Now that we have redesigned our website we have moved the M-L-Anderson content to that URL. We’ll keep the M-L-Anderson.com URL and site so that we can test changes to our site without impacting our live site.
What does this mean to you? It means that we as a concerned business are looking into the legal aspects of this issue with our advisors and will be taking the necessary actions to eliminate any marketplace confusion that exists. We have invested in our brand equity and have been actively promoting the name for several years.
So, for those of you asking yourself if Casual Elegance Photography is a chain/franchise the answer is NO. We are an independent, and privately owned small business that specializes in Boudoir, Glamour, and Art Nude Photography, dedicated to the personal attention that you, our clients expect.
